Sydney / NSW — the planning rules
NSW secondary dwellings are governed by Chapter 3 Part 1 of State Environmental Planning Policy (Housing) 2021, which succeeded the Affordable Rental Housing SEPP 2009 on 26 November 2021 and carried the framework across substantially unchanged. On a residential lot of 450 m² or more, a granny flat can be approved by a private certifier through a Complying Development Certificate (CDC) on a statutory 20-day determination clock — no Development Application and no neighbour consent required, though the certifier does notify neighbouring occupants before issuing. For lots under 450 m² or in restricted zones, a council Development Application is the pathway.

No DA, no neighbour consent, no council referral. The dwelling must be 60 m² or less of total floor area, meet the policy's setback and height standards (which all E2ES designs meet), stay on the same title as the main house, and cannot be subdivided off.

No. Under the complying-development pathway in State Environmental Planning Policy (Housing) 2021, neighbour consent is not required — the certifier notifies neighbouring occupants before issuing the certificate, but they are being told, not asked. That is a large part of why the Sydney approvals stage is short. Only on the DA pathway (lots under 450 m², or restricted zones) does council formally consult neighbours.

Liverpool, Campbelltown, Penrith, Blacktown, Camden and The Hills Shire are the strongest growth corridors with most CDC approvals. Inner-city councils (City of Sydney, Inner West, North Sydney) often restrict SEPP via LEPs and require DA. We confirm CDC eligibility at the free site visit.
Sydney is typically the fastest of the four cities: with the CDC determined on a statutory 20-day clock, the paperwork stage (design plus certificate) usually closes in about a month, then four weeks of construction on site, four to five for the dual. Decision to finished build is typically around two months; with leasing on top, decision to first rent is typically about two and a half months. Those are typical figures on a straightforward lot, not contractual commitments.
